An Erie County Supreme Court properly granted a petition to invalidate the designating petition of a Buffalo man seeking a seat in the U.S. House representing the 28th District.
The Appellate Division, Fourth Department on Friday affirmed the Aug. 11 decision of Judge Timothy J. Drury in the matter of Robert E. Brown v. Emin E. Egriu.
Brown, a committeeman with the Erie County Democratic Committee, challenged hundreds of signatures on Egriu’s designating petitions, which eventually left him with 233 less than he required to be included on the ballot.
The seat for the 28th Congressional District is held by Rep. Louise Slaughter, who is seeking her 13th two-year term. Without Egriu on the Democratic line, she no longer faces a Sept. 14 primary challenge.
