Background: The inquirer seeks to serve on a county community services board in the county where the judge presides. The service board is a planning agency for the overall provision of mental health related services in the county, including alcohol and substance abuse services. The community services board does not provide any services to which a defendant before a town or village justice court could be referred.
Opinion: The committee found that the serving as a county community services board member is permissible, so long as the part-time judge cannot refer persons who appear in his/her court to the community services board for services.
