Opinion 10-127

Background: A part-time judge inquired into the propriety of accepting employment as a process server. The judge stated that his employment would not take him into the jurisdiction of the court in which he presides.

Opinion: The committee has previously stated that a part-time judge may be employed as a private investigator for attorneys working with the public defender’s office. Similarly, a part-time judge may accept employment as a process server, but may provide such services only in matters that will not be heard in his court, either before him or his co-judge.
