Background: The respondent mother appealed from an order that terminated her parental rights and revoked a suspended judgment. 

Ruling: The Appellate Division reversed. The court found that the petitioner had met its burden that the mother had violated the terms of the suspended judgment. However, the mother and the petitioner alleged new circumstances requiring remittal. Specifically, the adoptive placement of the child was disrupted and the child is living in a group home. Further, the child no longer wishes to be adopted and wants to reestablish contact with his maternal grandmother.
