U.S. Court of Appeals for the Second Circuit

Second Amendment

Possession by a Felon

United States v. Bogle
11-349-cr
Judges Walker, Katzmann and Lynch

Background:  The defendant appealed his conviction for possessing a firearm and body armor as a convicted felon on the grounds that the conviction violated his Second Amendment right to bear arms.

Ruling: The Second Circuit affirmed. The court held that the Second Amendment right to bear arms is not to be taken to cast doubt on longstanding prohibitions on the possession of firearms by felons.

Nicholas J. Pinto for the defendant-appellant; Todd Kaminsky, assistant U.S. attorney, for the appellee
