Appealed from Family Court, Erie County

Background: The respondent father appealed from an order finding him in contempt of court based on his willful violation of a prior order of support.  The respondent father was incarcerated.

Ruling: The Appellate Division affirmed. The court found that even though the respondent had completed his prison sentence, the appeal was not moot. Further, the court found that the petition was legally sufficient.  It contained in bold letters the warning that a hearing was requested and that its purpose was to punish him for contempt.
