Fourth Department — Termination of Parental Rights: Matter of Alisa E.

By: Daily Record Staff//February 12, 2014

Appellate Division, Fourth Department

Termination of Parental Rights

Suspended Judgment

Matter of Alisa E.
CAF 12-01140
Appealed from Family Court, Livingston County

Background: The respondent appealed from an order revoking a suspended judgment and terminated her parental rights.

Ruling: The Appellate Division affirmed. The petitioner had established that the mother failed to obtain suitable housing until after the violation petition was filed and that she withdrew or limited releases for information from programs that she attended. The mother failed to verify that she had completed the programs and admitted that she did not know whether the petitioner had approved those programs. Further, the petitioner had demonstrated that the mother was living at her parents’ house and that her testimony to the contrary was not credible.

Charles J. Greenberg for the respondent-appellant; Wendy S. Sisson, county attorney, for the petitioner-respondent; Charles Plovanich, attorney for the child
