NYS Advisory Committee on Judicial Ethics
Part-time Judge
Statewide Advisory Council — Participation
Opinion 13-7
Background: A part-time judge asked whether he may accept an appointment to a legislatively established statewide council. The council reviews inmate grievances from local jail facilities in light of applicable laws and standards. The council then assesses and votes on whether the facility’s response is in compliance. If not, the council would make a recommendation to the facility.
Opinion: The committee concluded that a part-time judge may accept such an appointment as a volunteer member. The judge must abstain from participating in the review of any grievance originating from the county in which he serves as a judge. Further, service on the council should not be unduly controversial.
