Appellate Division, Fourth Department
Parental Rights
Providing for Child’s Future
Matter of Makayla S.
CAF 12-01884
Appealed from Family Court, Steuben County
Background: The respondent father appealed from an order that terminated his parental rights and ordered that his child be freed for adoption.
Ruling: The Appellate Division affirmed. The court held that petitioner made diligent efforts to encourage and strengthen the relationship between the father and the child by providing services and other assistance aimed at ameliorating or resolving the problems preventing the child’s return to the father’s care. Further, the father failed to substantially and continuously to plan for the future of the child despite being physically and financially able to do so.
