Background: The petitioner commenced an article 78 proceeding seeking to annul a determination that she committed maltreatment with respect to her two children.
Ruling: The Appellate Division confirmed. The court held that the respondent presented testimony of a caseworker who noted that the petitioner had been arrested for driving while intoxicated and that her two children were in the car with her when she was arrested.
