NYS Advisory Committee on Judicial Ethics

Fundraiser

Honoree – Mitigating the Use of the Judge’s Name

Opinion 15-60

Background: The inquiring judge had initially agreed to be one of multiple honorees at a fundraiser for a school the judge attended before college. The invitations sent out had the judge’s name on them as one of the honorees. The judge withdrew from the event upon realizing that the type of school does not fall under any exception. The coordinator of the event has orally and in writing made corrections. The inquiring judge asks if he may attend if he receives no award.

Opinion: The committee concluded that under the circumstances, the judge has taken appropriate and effective remedial steps to mitigate a school’s use of the judge’s name. He may attend the event.
