ALBANY — The chairman of the Assembly committee with authority over gambling predicts New York will legalize and regulate daily fantasy sports, noting many residents already play it online.
Assemblyman J. Gary Pretlow, who chairs the Committee on Racing and Wagering, says the approach state lawmakers take will depend on the outcome of the lawsuit filed by New York Attorney General Eric Schneiderman to block FanDuel and DraftKings from conducting what Schneiderman considers illegal gambling.
Pretlow chaired a hearing Tuesday where attorneys for both companies insisted, as they have in the court case, that daily fantasy sports are based mainly on the skill, not luck, and therefore don’t qualify as gambling.
If Justice Manuel Mendez finds it’s illegal, Pretlow says they’ll act to legalize it. Otherwise, they’ll take steps to regulate it.
