ALBANY — Gov. Andrew Cuomo has nominated former U.S. Attorney Michael Garcia to the remaining vacancy on New York’s highest court.
Garcia, currently a partner at Kirkland & Ellis in Manhattan, was the top federal prosecutor in Manhattan from 2005 to 2008.
Cuomo is a Democrat. Garcia is a Republican whose investigation into a prostitution ring led to the resignation of New York’s then Democratic Gov. Eliot Spitzer.
Cuomo says Garcia is a “talented, experienced, and skilled prosecutor” and has the “broad, well-rounded perspective on the law” that New York’s Court of Appeals requires.
Garcia was among seven possible nominees advanced by a state commission that found them all well qualified.
If confirmed by the New York Senate, he would replace Judge Susan Read. She retired last year from the seven-member court.
