Judge tosses murder conviction

A judge has tossed out the murder conviction of a man found guilty of playing a role in the fatal shooting of three people outside a Rochester community center last year.

Monroe County Court Judge Douglas Randall on Thursday set aside Jalen Everett’s Nov. 4 convictions on second-degree murder charges. The judge’s decision stems from an unspecified issue that occurred during jury deliberations, but no details have been released.

The 21-year-old Everett was charged along with two other men in the August 2015 shooting outside the Boys and Girls Club that killed three people and wounded three others.

One of the other men was convicted in June, while the third man is scheduled for trial next month.

District Attorney Sandra Doorley says she’s disappointed with the judge’s decision and an investigation into the jury issues is underway.
