New York State Advisory Committee on Judicial Ethics

Part-time town justice

Assistant conflict-defender

Opinion 13-23

Background: A part-time justice asks if he may be employed as a salaried conflict defender in the county in which his court is located. The conflict defender’s caseload is primarily in Family Court, although the judge also appears in a few town courts before non-attorney judges. The judge does not handle child protective proceedings, persons in need of supervision cases, or juvenile delinquency matters.

Opinion: The Committee concluded that a part-time town justice may serve as a part-time assistant conflict defender in the county in which the judge’s court is located.
