New York State Advisory Committee on Judicial Ethics

Prior client representation

Spouse is public official

Opinion 23-16

Background: The inquiring full-time judge has been assigned several cases involving a defendant hospital. The judge has been advised that the hospital’s risk manager is a former client on two discrete transactional matters. The attorney-client relationship ended seven years prior. Further, the risk manager’s spouse is a public official who was on the same slate as the judge last year. He publicly endorsed the judge.

Ruling: The Committee concluded that a judge need not disclose or disqualify from a case merely because a party’s high-level employee, who will be present in the courtroom, also was previously a client of the judge more than two years ago and is married to a public official who was recently on the same slate as the judge and who publicly endorsed the judge.
