United States v. Pastore

18-2482(L)

Judges Walker, Sullivan, and Nathan

Background: The defendant appealed from his conviction of attempted murder in aid of racketeering and possession of a firearm in furtherance of a crime of violence. He argues that his firearms conviction should be vacated because the predicate offenses are not crimes of violence.

Ruling: The Second Circuit affirmed. The court held that attempted murder in aid of racketeering is a categorical crime of violence.

Vivian Shevitz and Lucas Anderson, of Rothman, Schneider, Soloway & Stern, for the appellants; Jordan L. Estes, assistant United States attorney, for the appellee.
