Schiebel v. Schoarie Cent. Sch. Dist.

Background: The plaintiff claimed he was discriminated against on the basis of sex when the defendant conducted a Title IX investigation that found that he sexually harassed a student when he reached around to retrieve supplies from a cabinet. He appeals from the dismissal of his claim.

Ruling: The Second Circuit reverse. The court held that he plausibly alleged Title IX was violated. The court noted that the allegations indicate that the school district was deliberately indifferent to the truth or falsity of the accusations against the plaintiff because its investigation was so deficient as to constitute a sham and its decision was inexplicable. The Second Circuit also noted that the Title IX coordinator exhibited sex-based bias against the plaintiff.
