Background: The plaintiffs filed a lawsuit to recover damages for the accident-related injuries they sustained when a vehicle driven by a sheriff’s deputy collided with their car at an intersection. At issue is whether the trial court properly granted the defendants’ motion for summary judgment on the ground that the deputy did not act with reckless disregard.
Ruling: The Court of Appeals affirmed. The court noted that the deputy slowed down before proceeding through the intersection, came to a complete stop at least once, observed northbound traffic, waited for that traffic to yield, and turned on her overhead lights. Despite failing to turn on her air horn, the deputy’s actions did not present that she acted with a conscious indifference to the outcome of her actions.
