Appealed from Supreme Court, Monroe County

Background: The defendant appealed from his conviction of murder arguing that the verdict is against the weight of the evidence.

Ruling: The Appellate Division affirmed. The court noted an eyewitness identified the defendant as the shooter. Also, a person matching his description was seen on video surveillance riding a bike to and from the scene of the shooting right before and after the shooting took place on a route that matched the likely route to and from the defendant’s residence. Evidence established that the defendant had issues with the victim regarding a defective gun that the victim sold to the defendant within weeks of the shooting.
