United States Court of Appeals for the Second Circuit

Civil forfeiture — Straw owners — Constitutional standing

United States v. The M/Y Amadea, a Motor Yacht

25-869-cv

Judges Parker, Lohier, and Merriam

Background: The government initiated a civil forfeiture action against a luxury superyacht that is alleged to be owned by a Russian national subject to sanctions by the United States. The claimants filed a claim to the superyacht alleging they were the ultimate beneficial owner of it. They appeal from the grant of the government’s motion to strike their claim.

Ruling: The Second Circuit affirmed. The court held that the claimants lacked constitutional standing as mere straw owners of the superyacht.

Alexandra A.E. Shapiro, of Shapiro Arato Bach, for the claimants-appellants; Jennifer Jude, assistant United States attorney, for the plaintiff-appellee.
