New York State Supreme Court, Appellate Division, Fourth Judicial Department

Traffic stop — Vehicle identification

People v. Camber

KA 23-01766

Appealed from Supreme Court, Onondaga County

Background: The defendant appealed from his conviction of three counts of criminal possession of a weapon. He argues that the court improperly denied his motion to suppress physical evidence as the product of an unlawful stop.

Ruling: The Appellate Division affirmed. The court noted that law enforcement officers who reviewed surveillance video of a suspect firing a weapon from a vehicle took note of the make, model, and license plate color of the vehicle, the number of occupants, and details of their clothing. This information was relayed to a second office who then effected the stop of the vehicle in which the defendant was a passenger after confirming that the vehicle and its occupants matched the description of the vehicle from surveillance video.

Veronica Reed for the defendant-appellant; Elisabeth Cannan, of the district attorney’s office, for the respondent.
