People v. Miller

Appealed from Supreme Court, Monroe County

 

Background: Defendant was convicted of two counts of Murder second degree, and one count of Attempted Robbery first degree. On appeal he contended that the evidence was legally insufficient.

 

Ruling: Conviction affirmed. The defendant sought the help of his girlfriend’s brother to get a gun and/or find someone who was willing to kill the victim. On the day of the shooting, defendant several times stated that he was going to “get” get the victim. He directed his sister to contact the victim to come to her house, where the victim was shot by a codefendant in the defendant’s presence.
