United States Court of Appeals for the Second Circuit

Supervised release

Rationale for imposition of 20-year term

United States v. Williams

20-1021-cr

Judges Pooler, Sullivan, and Park

Background: The defendant was convicted of distributing child pornography, receiving child pornography, and possessing child pornography. He appealed from his sentence to a 20-year term of supervised release. He argues that the court committed procedural error when it did not separately explain its rationale for imposing a 20-year term of supervised release.

Ruling: The Second Circuit affirmed. The court held that the district court reviewed Section 3553(a) factors in imposing a term of imprisonment, and nothing in the statute or case law requires the district court to repeat the process in imposing a term of supervised release.

Melissa A. Tuohey, assistant federal public defender, for the defendant-appellant; Joshua R. Rosenthal, assistant United States attorney, for the appellee.
