Background: The plaintiff filed a motion to dismiss the defendant’s appeal from an order that denied his motion to correct errors in his judgment of conviction. The government argues that the appeal is moot because the court’s second order, making the corrections requested in the previously denied Rule 36 motion.

Ruling: The Second Circuit held that because the district court entered the second order while the defendant’s appeal challenging the first order was pending, the court lacked authority to enter the second order. Thus, the defendant’s appeal is not moot.
