Appealed from Family Court, Allegany County

Background: The respondent-petitioner mother appealed from an order that dismissed her petition seeking permission to relocate to Arkansas with the party’s child. The attorney for the child submitted new information to the Appellate Division that the mother married her fiancé, who resides in Arkansas and that the petitioner-respondent father has not exercised visitation with the child for the past 16 months.

Ruling: The Appellate Division reversed. The court remitted the matter to Family Court for an expedited hearing for a new determination in light of the new evidence submitted to the Appellate Division.
