Background: The petitioner sought review of an immigration officer’s decision to reinstate a prior order of removal against him and the determination that he does not qualify to pursue claims for withholding of removal to India.
Ruling: The Second Circuit dismissed the appeal. The court held that they lack jurisdiction as the petition raises questions of law and fact arising from efforts to remove him from the United States but the petitioner does not present the Second Circuit with a reviewable final order.
