Background: The state legislature passed a law that nullified Freedom of Information Act exemptions, including the provision in the police union’s collective bargaining agreement. At issue is whether it was an abuse of discretion to deny the police union’s motion for a preliminary injunction on the ground that the union was unlikely to succeed on the merits of its contracts clause claim.

Ruling: The Second Circuit affirmed. The court held that the law the union sought to enjoin was reasonable and necessary to achieve a legitimate public purpose, there is no error in denying the motion.
