Opinion 23-28

Background: A full-time judge asks if he may serve on the board of directors of two local not-for-profit organizations. One partners with students to ensure they are ready for, enroll in, and complete college and it does not engage with the court system at all. The other provides community mediation services including small claims court.

Opinion: The Committee concluded that it is ethically permissible to serve on the board of directors for the first not-for-profit as it does not engage in adversarial proceedings and does not receive referrals from the court. With regard to the second not-for-profit organization, it is likely to be engaged in regular adversarial proceedings. Thus, it is not ethically permissible to serve on the board of directors.
