Background: The plaintiff commenced an action alleging legal malpractice. It appealed from the dismissal of its complaint as time-barred and from the denial of its motion to remand the action to state court.

Ruling: The Second Circuit vacated and remanded. The court held that the federal question embedded in the malpractice claim did not fall within the narrow category of disputed and substantial questions of federal law permitting the exercise of federal jurisdiction over the state law claim.
