United States Court of Appeals for the Second Circuit

School immunization — Religious exemption — Neutral

Miller v. McDonald

24-681

Judges Cabranes, Wesley, and Lee

Background: Parents of Amish students, Amish community schools, and an elected representative of Amish schools sued New York claiming that the school immunization law infringes on their free exercise rights under the First and Fourteenth Amendments. They appealed from the grant of the defendant’s motion to dismiss.

Ruling: The Second Circuit affirmed. The court held that the law at issue is neutral as it applies to all schoolchildren who do not qualify for the law’s medical exemption, nor did it target religious beliefs.

Shannon G. Denmark, of Lehotsky Keller Cohn, for the plaintiffs-appellants; Mark S. Grube, of the NYS Office of the Attorney General, for the defendant.
