Appealed from Family Court, Erie County
Background: The respondent appealed from an order that determined that he neglected the subject children.
Ruling: The Appellate Division affirmed. The court held that the record established that the respondent mother left one of the children in the care of the respondent and that the child sustained bruising and a cut on an arm as a result. Furthermore, both children were exposed to domestic violence between the mother and the respondent.
