Opinion 10-189

Background: The inquiring judge is also a professor of law. He asks whether it is permissible to discuss pending judicial decisions that are relevant to the class topic.

Opinion: The committee found that, while a judge may not make public comment about a pending proceeding, a judge is permitted to speak, write, lecture and teach. Therefore, the judge-as-teacher may discuss cases during his law school class that are relevant to the subject matter, but not on a case in which he is presiding or one pending in the jurisdiction he presides.
