Background: The plaintiff commenced an action seeking damages after falling down a flight of stairs at the defendant’s residence. The plaintiff appealed from the grant of summary judgment to the defendant.
Ruling: The Appellate Division reversed. The court found that there was a triable issue of fact regarding the property was maintained in a safe condition. The hallway was unlit. The plaintiff was attempting to enter a bathroom, but, instead, opened a door to the basement.
