Federal lawsuit against Insomnia Cookies settled

A settlement has been reached in a federal lawsuit filed by a delivery driver who accused his employer, LLC, of violating state and federal labor laws.

Plaintiff Joseph Lee accepted a settlement offer of $12,000. Insomnia also will pay $9,000 to cover Lee’s attorney fees, according to court documents.

Lee, who worked at the Insomnia store at 1333 Mount Hope Ave. from March 2019 to March 2022, filed the lawsuit on June 14, 2023. He is represented by Queens attorney John Troy.

In March, U.S. District Court Judge Frank P. Geraci Jr. issued a decision that granted part of a defense motion to dismiss the case, but he also denied part.

The claim for failure to pay minimum wage under the federal Fair Labor Standards Act was dismissed. Lee’s claim for misappropriation of tips was allowed to proceed.

Geraci also dismissed the lawsuit against other defendants.
