Daily Record Staff//August 3, 2023//
Of Counsel, Tully Rinckey, PLLCYears in current role: 5 (49 in practice)
What is one thing you hope to accomplish before the end of the year?
I hope to resolve a few complicated and prolonged estate administrations while retaining a balance between my professional life and my family.
What do you think the biggest change in your practice area will be over the next 3-5 years?
There will be many changes, some that we can anticipate and some that we cannot predict. In 2023, very few estates are subject to federal estate tax (only estates larger than $12.2 million for an individual and $25.84 million for a married couple). However, many more estates are likely to become subject to federal estate tax when the changes that were enacted in the 2017 Tax Cuts and Jobs Act expire after 2025. Changes in cultural norms and advances in medical science will accelerate and provide new and unforeseen challenges to our practice. There will be less in-person interaction with clients as more practitioners work remotely and for clients outside of the local community. More estates will involve international issues due to increased mobility.
What do you enjoy most about practicing law in the Rochester area?
I enjoy the opportunity to meet and interact personally with new individuals for whom I can clarify frequent misconceptions. For example, clients are often surprised to learn that the probate process involves obtaining Surrogate’s Court jurisdiction over all of a decedent’s next of kin, not just dealing with those legatees named in a Will. I like to help people to navigate the estate planning and estate administration processes and avoid possible pitfalls. Since my practice currently extends throughout New York State, I regret not being able to meet all my clients in person.
