What is one legal issue or trend you’re keeping a close eye on this year?

I am seeing much more FLSA wage and hour litigation over the last few years. While I thought that the trend was slowing, it seems to be continuing again this year. I am also seeing a decrease in restrictive covenant litigation, which may be the result of threats to pass rules limiting or eliminating the enforceability of post-employment restrictive covenants at both the federal and New York State levels.

What skills do you think are most crucial for new attorneys entering the field today?

New attorneys will need to learn to work with AI in a professionally responsible manner, which should not be a revelation to anyone reading this. However, advances in technology will not assist a young attorney who lacks intellectual curiosity and a strong work ethic. All the best lawyers I know possess a combination of those two qualities.

What’s one misconception people often have about your area of law?

Although I am a litigator, I rarely go to court anymore. Since the pandemic, most judges prefer to handle matters on submission, and if a meeting or court appearance is required, it is usually conducted virtually. I will editorialize here and state that I think the profession is the worse for the lack of personal contact. I find that without face-to-face meetings, both parties and their attorneys find it easier to create animosity over minor issues, and situations tend to conflagrate much more readily. If parties and their attorneys spend some time in the presence of one another (and the Court), they have an opportunity to see their situation less myopically. I also think it is good for younger attorneys to observe more experienced attorneys in order to hone their skills.

How does the Rochester community influence your work or professional philosophy?

Rochester is a unique place in the sense that it is a relatively small city, but it has a remarkable world view. I am constantly meeting people who have business interests all across the country and indeed, around the world. I suspect the fact that Kodak, Xerox and B&L made Rochester their homes at times in the past plays a large role in the national and international flavor of work here. Whatever the reason, I think this world view helps to put things into perspective, which is what attorneys and their clients often need in order to resolve disputes.

What’s your ideal way to spend a weekend in the Finger Lakes or Western New York?

I love to spend time outdoors and this area has a lot to offer. This area has some real gems, such as the Monroe County parks, Letchworth State Park and the Finger Lakes National Forest, where trail running, hiking and cross-country skiing are all easily accessible. A relaxing pint with family or friends at the Sheffield is a great way to finish the day.
