What is one legal issue or trend you’re keeping a close eye on this year?
Since 2023, many counties and other municipalities have been named in federal court actions, both non-class and class actions based on the recent U.S. Supreme Court decision rendered in Tyler v. Hennepin County, 598 U.S. 631 (2023). After Tyler, Plaintiffs, as former owners of foreclosed real property, filed legal actions asserting constitutional challenges seeking the return of surplus funds and other damages resulting from municipal governments’ in rem tax sales. The number of claims is increasing statewide. Counties are faced with the potential of having to return millions of dollars in surplus sales proceeds resulting from sales that occurred many years ago. We are defending 21 counties in these actions.
What skills do you think are most crucial for new attorneys entering the field today?
After 38 years of practice, I believe the two most important skills for both new attorneys and seasoned practitioners are (i) empathy and (ii) attention to detail. An attorney must understand the client’s legal problem by focusing on all of the fine details and legal concepts and then with that knowledge, apply empathy while resolving those concerns.
How does the Rochester community influence your work or professional philosophy?
Growing up in the Greater Rochester community has impacted my professional philosophy in a dynamic way. Rochester is known for its philanthropic efforts and high intellectual capital in its institutions and people. Innovation coupled with empowering the community we serve has been the key influence shaping and enriching my professional life.
