The Fair Labor Standards Act would be extended to apply to home care workers under a bill that has been introduced in the Senate.
The Direct Care Job Quality Improvement Act, co-sponsored by Sens. Tom Harkin, D-Iowa, and Robert P. Casey, Jr., D-Pa., would ensure that home care workers receive wage and overtime protection, monitor the capacity and quality of the direct care workforce, and establish programs to improve recruitment, retention and training.
The FLSA currently excludes home care workers from these protections.
“The people who care for the elderly and Americans with disabilities shouldn’t be left wondering how they will care for their own families,” Sen. Harkin said in a statement after the bill was introduced. “Direct care workers make it possible for people to stay in their homes and live with independence and dignity, and this bill will help them achieve the same by reinforcing their rights and ensuring fair compensation for their work.”
An identical bill was introduced in the House, sponsored by Rep. Linda Sanchez, D-Calif.
